Voice Cloning Consent & Disclosure

1. Purpose of This Document

This Voice Cloning Consent & Disclosure ("Consent") governs the creation and use of custom synthetic voices ("Voice Clones") produced by Brilliant5 Inc. ("Brilliant5," "VoiceConnect," "we," "us," or "our") on behalf of a Customer. It is incorporated by reference into the VoiceConnect Terms of Service. Voice cloning is not a self-service, in-application feature; Voice Clones are created only manually, at a Customer's express written request, and only after the consent requirements in this document are satisfied.

2. What a Voice Clone Is, and Why Consent Is Required

A Voice Clone is a synthetic voice model generated from one or more audio samples of a human voice (a "Voice Sample"). To create it, we process a voiceprint derived from the Voice Sample. A voiceprint is biometric data and is treated as sensitive / special-category personal information under laws including the EU and UK General Data Protection Regulation (Article 9), Canada's PIPEDA and Quebec's Law 25, the Illinois Biometric Information Privacy Act (BIPA), and the Texas Capture or Use of Biometric Identifier Act (CUBI). Because of this, voice cloning requires specific, informed, written consent that is separate from general acceptance of our Terms of Service — accepting the Terms of Service alone does not authorize the creation of a Voice Clone.

3. Whose Consent Is Required

A Voice Clone may be created only from the voice of: (a) the individual making the request, using a recording of their own voice; or (b) a third individual (the "Voice Owner") who has provided explicit, written, AI-cloning-specific consent to the Customer, a copy of which the Customer must retain and provide to us on request. The Customer requesting the Voice Clone represents and warrants that one of the above applies and that all necessary consents and notices have been obtained and given. The Customer bears full responsibility and liability for the lawful basis of every Voice Sample it submits.

4. Informed Consent — What the Voice Owner Agrees To

By consenting to the creation of a Voice Clone, the Voice Owner acknowledges and agrees that: a biometric voiceprint will be created from their Voice Sample and used to synthesize speech in their voice; the Voice Clone may generate speech the Voice Owner never actually spoke; the Voice Clone will be used only for the lawful business purposes the Customer has described and authorized; consent is voluntary and may be withdrawn at any time (see Section 7), after which no new audio will be generated from the Voice Clone; and biometric data carries inherent risks, and no security measure is perfect.

5. Permitted and Prohibited Uses

Voice Clones may be used only for the Customer's legitimate, disclosed business purposes. Voice Clones must not be used to: impersonate any person without authorization; commit fraud, deception, or social engineering; produce defamatory, harassing, discriminatory, sexually explicit, or unlawful content; evade caller-identification or AI-disclosure obligations; or generate political, electoral, or emergency content designed to mislead. Where an interaction uses a synthetic voice, applicable AI-disclosure and call-recording-consent obligations (see our AI & Recording Disclosure) continue to apply.

6. Storage, Security, and Retention

Voiceprints and Voice Samples are processed and stored using the same encryption-in-transit-and-at-rest, access-control, and audit-logging safeguards described in our Privacy Policy. We retain a Voice Clone and its underlying Voice Sample only as long as needed to provide the service to the Customer, or until consent is withdrawn or deletion is requested, whichever is earlier, subject to any legal retention obligation.

7. Withdrawal of Consent and Deletion Rights

The Voice Owner or the Customer may request, at any time, that we deactivate and delete a Voice Clone and its underlying voiceprint and Voice Sample. Requests should be sent to legal@voiceconnect.io. Upon a valid request we will cease generating new audio from the Voice Clone and delete the associated biometric data within a commercially reasonable period, subject to legal retention requirements. Withdrawal does not affect audio already generated before the request.

8. Customer Responsibilities and Indemnity

The Customer is solely responsible for: obtaining and retaining all required consents; ensuring lawful use of every Voice Clone; complying with all applicable biometric-privacy, AI-disclosure, and call-recording laws; and honoring Voice Owner deletion requests it receives directly. The Customer agrees to indemnify and hold harmless Brilliant5 from any claim arising out of Voice Samples it submits or Voice Clones it uses, consistent with the indemnification section of the Terms of Service.

9. No In-Application Cloning

For clarity, VoiceConnect does not currently offer in-application voice cloning. All Voice Clones are created through a manual, request-based process in which this Consent is executed before any voiceprint is generated. If in-application voice cloning is introduced in the future, an equivalent in-product consent flow will be required at the point of creation.
